21th February 2022 –Michalina Marcia – Big Brother and the Constitution Seminar
During the Seminar Michalina Marcia discussed the subject of new technologies in gathering evidence in criminal proceedings in the context of the right of defence. She analyzed the existing models of data collection as part of the criminal proceedings, obtaining the content of messages and metadata, as well as difficulties in establishing a consistent classification of data categories. She talked about threats to the right of defence, including the right to active participation in the proceedings, or privilege against self-incrimination, related to the use of digital evidence. She also talked about her intended research objectives, basic research questions related to the indicated topic and planned comparative research
Michalina Marcia is a Research Assistant at Digital Justice Center and a PhD candidate at the Chair of Constitutional Law (Faculty of Law, Administration and Economics, University of Wroclaw).
