Kamil Sobański’s new paper is now out in the Journal of International Criminal Justice

We’re glad to share that Kamil Sobański’s new research article, ‘Making it Right – Remote Participation of the Accused in International Criminal Court Trials,’ is now out in the Journal of International Criminal Justice (Oxford University Press) in Open Access.

In this legal essay, he proposes a new configuration of remote participation of the accused via video link that fully takes defense rights into account, on the one hand, and he calls for recognizing remote presence as part of the right to be present, on the other. He argues that granting the accused the right to participate remotely in ICC trials has become essential, as current digital technology narrows the gap between physical and remote presence and allows for less disruptive proceedings for the accused.

These considerations build on Kamil Sobański’s earlier research: an article on the evolution of remote participation of the accused and victims in international criminal proceedings, published in the International Criminal Law Review (see: https://brill.com/view/journals/icla/25/1/article-p167_006.xml), and an article on the digitalization of public access to criminal trials, published in the European Journal of Crime, Criminal Law and Criminal Justice (see: https://brill.com/view/journals/eccl/33/1-2/article-p84_005.xml).

All of these papers constitute preliminary results of Kamil Sobański’s PhD project, ‘Virtual Justice: Remote Proceedings before the International Criminal Court – Threat or Opportunity?’ funded by the Polish National Science Centre (NCN), grant no. 2022/47/O/HS5/01229 (see: https://digitaljustice.uwr.edu.pl/en/projects/virtual-justice-remote-proceedings-before-the-international-criminal-court-threat-or-opportunity-2023-2027/), which he carries out at the Digital Justice Center at the University of Wrocław.
