? In July 2023, the European Union implemented the ‘electronic evidence package’ after prolonged negotiations aimed at addressing flaws in existing legal instruments for collecting data in criminal proceedings. The primary challenge addressed by the package is the cross-border nature of data, often located in a different country than the proceedings, requiring enhanced cross-border cooperation tools. The key component is the European Evidence Warrant, enabling law enforcement in one Member State to request data from ISPs in another, potentially shifting the role of service providers in safeguarding fundamental rights. The seminar aimed to discuss the package’s background, critically assess its foundations, and analyze its implications and future steps in the evolution of international data extraction tools for criminal proceedings.

?‍? Stanisław Tosza holds the position of Associate Professor of Compliance and Law Enforcement at the University of Luxembourg serving as the Director of the Bachelor in Law program. He is also the Secretary General of the International Association of Criminal Law (AIDP), and advisor to the European Commission on new technology regulations within the Innovation Friendly Regulations Advisory Group (IFRAG). His extensive research portfolio spans comparative, economic, and European criminal law, as well as cybercrime, with notable contributions including three books and recent articles on electronic evidence collection.
