Virtual Justice. Remote Proceedings before the International Criminal Court \u2013 Threat or Opportunity?<\/strong><\/h1>\n\n\n\n

This grant was awarded in the PRELUDIUM-BIS 4 competition. The purpose of this program is to support the education of doctoral students by providing a PhD scholarship allowing to carry out a research project, and promoting international mobility.<\/p>\n\n\n\n

Aims and analysis details:<\/strong><\/p>\n\n\n\n

The aim of the project is to analyze the clashing interests of accused, victim, witness and the public when criminal proceedings are conducted remotely, i.e., using digital technology that allows all parties to the proceedings and the public to connect remotely. <\/p>\n\n\n\n

The main research question is how to balance the often mutually exclusive rights of those involved in criminal proceedings when the proceedings are conducted remotely. In order to find the answer we should assume that the digitalization of the criminal process is inevitable. Since digital technology is present in our daily lives, also the criminal justice system cannot be left behind.<\/p>\n\n\n\n

The analysis has been be carried out on the example of criminal proceedings before the International Criminal Court<\/a> (ICC). The reasons for choosing such a research background are several. First, the ICC has a unique understanding of the use of technology during criminal proceedings and significantly distinguishes itself in this regard, through its long-standing use of technology and infrastructural adaptation to the digital transformation long before the pandemic. Secondly, ICC, formed at the intersection of the inquisitorial and adversarial systems, carries in its criminal proceedings a unique blend of continental and common law traditions. As a result, the analysis of the problem based on the example of ICC proceedings has more universal appeal. Third, the impact of the ICC on national systems should not be underestimated, especially in the context of the mechanism of positive complementarity. National criminal courts look up to the achievements of the ICC and often refer to its jurisprudence. Accordingly, the conduct of remote hearings by the ICC and the principles applied to date are likely to be further followed by national courts.<\/p>\n\n\n\n
